L’obbligo di previo giudizio incidentale nel processo antidiscriminatorio su regolamento (riproduttivo di legge regionale)

THE OBLIGATION OF PRIOR CONSTITUTIONAL ADJUDICATION IN ANTI-DISCRIMINATION PROCEEDINGS IF IT IS AIMED AT AMENDING A REGULATION REPRODUCING A REGIONAL LAW (HOWEVER DISAPPLICABLE). With judgement 15/2024, the Constitutional Court decided a conflict of attribution and an incidental judgement generated by challenges to the discriminatory nature of a regional law. The ruling assumes particular inte-rest because it establishes the impossibility for the common judge to order an amendment to the imple-menting regulation, without prior constitutional adjudication, thus enriching with a new «special» case the jurisprudential evolution started since the obiter of ruling 269/2017.
