The Court of Rovereto states that the claim for damage from defamation in the press and the one related to the violation of the right to correction are independent of each other due to the difference between the legal assets protected by the crime of defamation and by the right of correction. The Judge, after rejecting the claim for damage from defamation, ascertains that the defendant has violated art. 8 of Italian Press Law on the right of correction; nevertheless, it rejects the claim for damages brought by the plaintiff for failing to prove any actual harmful consequences. However, the Court condemns the defendant to publish the sentence in excerpt in the same newspaper where the articles were published.
