The author focuses on the articles of the Spanish Constitution of 1812 which disqualified the holders of an office under the crown from sitting in parliament.Through these determinations, however, the Spanish constituents didn’t intend to carry out the principle of separation of powers, and in particular of separationof the legislature from the executive, because they distrusted the latter: rather they wanted to lay the foundations for a modern relationship between government and administration, in the belief that without active support of the latter no constitutional government could stand against the machinations of the reaction.
