The making of Gratian’s Decretum is a question that remains to be resolved. The thesis of the ‘living text’ and the thesis of the ‘two recensions’ appear non-conflicting. The use of the Decretum in a lot of geographical areas and in the circle of the praxis, other than in the schools, suggests that the mss P, Sg, Fd, Bc, Aa are short and all different Concordiae, because of the different user needs. The increasing process of legal development of the Decretum required that it was added with some blocks of auctoritates taken from some long and quite finished text (e.g. Ty, Tz, Pv). So Gratian’s Decretum seems to be an ‘open text’: a living text, during its first circulation, but tending to become a chosen and finished text at the time of the «Kurze Dekretalenanhänge».
