Comparazione fra quanto stabilito dalla Corte costituzionale italiana sul caso Ilva e quanto sostenuto dal Tribunal Constitucional spagnolo sul Covid-19

TWO DIFFERENT VARIATIONS OF THE RIGHT TO HEALTH: FROM THE BALANCE OF RIGHTS IN THE ILVA CASE TO THE PREVALENCE OF THE RIGHT TO LIFE OVER THE RIGHT OF ASSEMBLY IN THE COVID-19 ERA. Talking about the right to health in the summer of 2020 means necessarily taking into account hurricane Covid-19 which has hit not only people and health systems around the world, but also the political stability of the different systems, and in the democratic ones of keeping the system of individual and collective freedoms, of jurisdictional guarantees and of everything that contributes to qualifying a system as, precisely, democratic. This article focuses on a comparison between the Italian and Spanish systems regarding the right to health, in particular on two judgments of the respective Constitutional Courts (Constitutional Court for Spain), the Italian one, of 2013, of the pre-Covid era. 19 and the Spanish one issued in the midst of the Coronavirus crisis, in 2020.
