Embora os sistemas jurídicos euro-continentais tradicionalmente se tenham assentado no lema de von Jhering “Kampf um’s Recht” (Luta pelos teus direitos!), há que se reconhecer que o panorama jurídico vem evoluindo gradualmente ao longo do tempo. A função jurisdicional é uma função preciosa e a sua utilização deve ser limitada aos casos em que o exercício dos poderes de julgamento do juiz seja estritamente necessário, encaminhando-se, assim, todos os outros litígios para mecanismos extrajudiciais de resolução de conflitos. A utilização adequada dos instrumentos extrajudiciais reforça, sem dúvida, a aplicação do princípio da proporcionalidade, enquanto princípio processual que tem crescido na Europa desde o início do século XXI. Esta nova abordagem em relação à resolução de conflitos abriu caminho para o desenvolvimento de uma nova cultura de gestão de conflitos, que, por sua vez, deve desativar a escalada de conflitos e promover a coesão social. O sistema jurídico italiano pode servir a um perfeito “estudo de caso” da tendência lenta, mas inexorável, para uma nova abordagem da resolução de litígios civis e comerciais. The judicial function is a precious resource, and its use must be limited to instances where the exercise of the judge’s adjudicatory powers is strictly necessary, thus directing all other disputes toward out-of-court dispute resolution mechanisms. The appropriate use of extrajudicial instruments undoubtedly bolsters the implementation of the principle of proportionality as a procedural principle grown across Europe since the start of the 21st century. This novel approach to conflict resolution has paved the way for the development of a new conflict management culture, which will in turn defuse conflict escalation and promote social cohesion. The Italian legal system represents a perfect ‘case study’ of the slow but inexorable trend towards a new approach to the settlement of civil and commercial disputes. Accordingly, the analysis will focus on the journey Italy has undertaken towards a widespread acceptance of one of the most significant alternative dispute resolution mechanisms, namely mediatio

Abstract

Although Euro-continental legal systems had traditionally been grounded on von Jhering’s motto “Kampf um’s Recht” (Fight for your Rights!), it must be acknowledged that the legal landscape has gradually evolved over time. The judicial function is a precious resource, and its use must be limited to instances where the exercise of the judge’s adjudicatory powers is strictly necessary, thus directing all other disputes toward out-of-court dispute resolution mechanisms.
