This case note discusses the judgment rendered on the 20 August 2019 by South Africa Constitutional Court (CC) on the failure by the Department of Rural Development and Land Reform (The Department) to process land claims. The decision is of special interest in terms of the interpretation of the separation of powers doctrine in South Africa, as well as the active role of the judiciary in advancing the land reform program.
