The article aims at analysing the relationship between the administration of structural funds and the Courts’ circuit dealing with judicial review. In the field of structural funds, member States are charged of the management of the funds but EUCommission exercises an important role in the decision making process. Nevertheless, the Court of Justice does not recognize that Commission' decisions can affect individuals and denies standing to them, assuming that the only subjects concerned by Commission's decisions are member States. The article criticises the substantial inadequacy and inconsistency of this approach.
