Sull'inutilità del processo in Salvatore Satta, ovvero: sul valore filosofico dell'esperienza giuridica

The aim of this paper is to propose some reflections on Salvatore Satta’s thought with the aim to investigate the relationship between philosophy and law, or, better to say, the possible philosophical value of legal experience. To do this, at first, I will take into consideration the reason why, according to Satta, the trial has no purpose, thus discovering the Mistery that constitutes it and that has nevertheless been removed by the modern age. This will give me the opportunity to question the nature of philosophical knowledge and its ostensible worthlessness, also in relation with law and the typical activity of the jurist, which consists in a work of creating concepts. In this way, I will finally be able to consider the origin of the philosophical experience, since has always been identified with the ‘wonder’, by trying to connect it to the legal one.
