Commons (in Italian “beni comuni”) occupy the centre of legal debate from different perspectives. The author deals with the possible Roman roots of this topic with some criticism from the point of wiew of the method. The author stresses the opportunity to use a correct and historical approach, avoiding short circuits and superimpositions (“autoproiezioni” according to Riccardo Orestano) between the present and the past.
