Tanulmányom a Pázmány Péter Katolikus Egyetemen 2019. május 31-én tartott előadásom szerkesztett változatát adja közre. Előadásom megtartására az Egyetem Jogbölcse leti Tanszékének szervezeti keretei között működő Ius Naturale kutatócsoport kért fel, mivel az idei évben a „Természetjog kiváló kutatója” megtisztelő címet személyemnek ítélte a Kutatócsoport tisztelt Bizottsága. Tanulmányomban a jogfilozófia és a jogi logika iránti elmélyült érdeklődésem kibontakozásról írok. Az első három alegységben azon olasz jogtudósok fontosságára hívom fel a figyelmet, akik rendkívül meghatározó kritikai észrevételeket fűztek épp úgy a kelseni normativista felfogáshoz, mint Summa210 Szent Ágoston és Francesco Petrarcha filozófiájához és logikájához. E részekben leginkább a rétorika és az igazság viszonyát vizsgálom. Az ötödik alegységben, egészen a neoplatonikus gondolkodásig visszanyúlva, a modern gondolkodás eredetét vonom vizsgálódás alá. Az utolsó három alegységben kiterjesztem vizsgálódásom spektrumát a kortárs érvelés-elméletekre és azt kutatom, mivel magyarázható, hogy a jogi logika számos elmélete drámai módon elveszíti igazság-orientált jellegét.

This is the published version of the speech delivered on the occasion of the awarding of the honorific title of ‘Distinguished Scholar of Natural Law’ in Pázmany Péter Catholic University, Budapest, May 31st, 2019. It provides some insights on the developments of my studies in the field of philosophy of law and legal logic. In the first three sections I stress the crucial role played by some Italian authors very critical of Kelsen’s normativism, as well as the philosophy and logic conceived by St. Augustine of Hippo and Francis Petrarch (my first two objects of research). In these sections I focus mainly on the relationship between rhetoric and truth. In the 5th section I discuss the origins of modern thought as far as they would be rooted in Neoplatonic philosophy. In the last three sections I extend my gaze to contemporary legal argumentative theories and to the dramatic loss of the sense of reality which characterizes many accounts on judicial logic.

Abstract

This is the published version of the speech delivered on the occasion of the awarding of the honorific title of ‘Distinguished Scholar of Natural Law’ in Pázmany Péter Catholic University, Budapest, May 31st, 2019. It provides some insights on the developments of my studies in the field of philosophy of law and legal logic. In the first three sections I stress the crucial role played by some Italian authors very critical of Kelsen’s normativism, as well as the philosophy and logic conceived by St. Augustine of Hippo and Francis Petrarch (my first two objects of research).
