Abstract
IN SEARCH OF A COMMON LANGUAGE: INTERACTIONS BETWEEN LAW AND LIFE SCIENCES IN COMPARATIVE PERSPECTIVE. The article assumes the existence of various form of integration of rules produced by Parliament and declares the physiology of this process, especially when science is involved in the regulation of biolaw. The focus moves then on the characteristics of such integration, with a specific focus on what is defined ‘endo”-legislative integration. Accordingly, a systematisation of different legislative techniques which can be implemented in order to open legislative text to the scientific di mension, which is based on the identification of the tools, nature, subject and object of reference to science. The comparative analysis of the relevant constitutional case-law contributes to confirm the existence of a direct link between the legitimacy of the law and the inclusion of science in both law-making and law-enforcement processes.File | Dimensione | Formato | |
