The article assesses in a critical vein the four judgements issued by the third section of the Italian Corte di Cassazione and the judgement of the four th Section of the Italian Consiglio di Stato with which in June 2017 in both the civil and administrative jurisdictions the two highest Cour ts in charge to ensure the uniform interpretation of the law have been required to reassess the conceptual foundations and the judicial administration of the principle of the so-called « compensatio lucri cum damni » principle in the Italian legal system.
