Under the Italian legal system the actions in order to claim compensation for the damages caused to the environment rest essentially in the hands of the Ministry of the Environment. However, a tendency has been noticed for the environmental associations to claim damages from liable operators before the national courts. Through these actions, though, the associations cannot claim damages on behalf of the environment but only the reparation of their own rights. This article puts forwards some suggestions in order to grant the associations a more prominent role when taking action for the protection of the environment.
