La contribución de la víctima y la imputación objetiva del resultado en la teoría del delito imprudente: un estudio comparado en materia de prevención de riesgos laborales

The author deals with the issue of the careless contribution of the victim in realizing harmful events within the theory of criminal negligence (the judicial definition of the duty of care of the employer) and objective imputation (objektive Zurechnungslehre). The paper analyzes both Italian and Spanish experiences to highlight how the theoretical debate that characterizes each country deeply influences the respective jurisprudential orientations. The author maintains that Criminal Courts should consider and assess the careless behavior of the victim (Selbstgefährdung) addressing the normative construction of the employer’s duty of care through the normative criterion of predictability (ex ante) and according to the socalled “principle of confidence” (Vertrauens-grundsatz).
