Il rapporto funzionale tra i concetti di sport e salute è stato riconosciuto e valorizzato, nel corso degli ultimi anni, sia a livello nazionale che sovranazionale. Il legislatore italiano ha attribuito un peso rilevante alle disposizioni in materia di sport e salute nel redigere la nuova disciplina dello sport del 2021. La riforma è seguita ad un’operazione politica che ha profondamente segnato gli equilibri di potere sussistenti tra i due principali enti sportivi italiani, ossia il CONI e la Sport e Salute S.p.a., società controllata dal Governo. La Sport e Salute S.p.a., oltre a contenere un evidente riferimento al rapporto tra sport e salute nella propria denominazione sociale, è disciplinata da uno statuto che preordina la società a svolgere attività a favore di soggetti che operano nel campo dello sport e della salute, nonché ad organizzare progetti finalizzati allo svolgimento di attività nei medesimi ambiti. All’indomani della riforma ci si è, tuttavia, chiesti in che misura la grande attenzione alle modifiche in materia di sport e salute sia figlia di un genuino disegno riformatore o se essa sia stata concepita per giustificare lo spostamento della gestione di rilevanti economici dal CONI alla società governata dall’esecutivo (e quindi dalla politica). Questo studio si propone di verificare la reale portata dell’innovazione introdotta dalla riforma, attraverso un’attenta analisi delle sue disposizioni, per vagliarne i contenuti innovativi e i problemi che le novità legislative prospettano all’interprete. Nel primo capitolo vengono ripercorsi nascita, evoluzione e rapporti intercorrenti tra il CONI e la Sport e Salute S.p.a.; a ciò segue uno scrutinio diacronico delle fasi che hanno condotto alla riforma dello sport del 2021. Il secondo capitolo è dedicato all’analisi delle tutele concernenti stricto sensu la figura dello sportivo: vengono saggiate le discipline dei controlli medici, dell’assicurazione contro gli infortuni e della tutela pensionistica; ci si raffronta, poi, con le misure approntate a favore degli sportivi minori d’età e dei diversamente abili. Nel terzo ed ultimo capitolo si scrutinano le maggiori novità in materia di tutela della salute dello sportivo. Alla disamina di quelle che sono le nuove professionalità sportive riconosciute dalla riforma, ove particolare attenzione viene rivolta alla figura del chinesiologo, segue una trattazione dedicata alle palestre della salute, strutture per la prima volta disciplinate da una normativa nazionale e che costituiscono un importantissimo strumento ai fini della prevenzione delle patologie croniche non trasmissibili. In entrambi i casi, inoltre, viene proposta la necessaria analisi dei profili di responsabilità che possono venire in gioco nell’esercizio delle rispettive attività.

The strong relationship between the concepts of sport and health has been recognized and valued, over the past few years, both at the national and supranational level. The Italian lawmaker made of this relationship the cornerstone of the newly enacted sport law reform of 2021. The reform followed a political move that deeply affected the balance of powers existing between the two main Italian sports institutions, namely CONI and Sport e Salute S.p.a., a new company controlled by the Government. The question that arises is whether the great attention paid to the changes in the field of sport and health is the result of a specific reform design or is merely intended to justify the transfer of important economic interests from CONI (the institution representing the autonomy of the sport legal order via a vis the State) and the government. This work aims at providing an answer to this question. Sport e Salute S.p.a., in addition to containing a reference to the relationship between sport and health in its name, it is provided with a statute that clearly indicates how the company is intended to carry out activities in favor of subjects operating in the field of sport and health, as well as to organize projects aimed at carrying out activities in the same areas. These institutional arrangements are not conclusive. To verify if the idea that the relationship between sport and health has consistently shaped all the areas interested by the 2021 reform, a scrutiny of all the provisions of this latter is carried on, assessing the completeness and quality of the new legislation and the actual existence of innovative content in the reform. In the first chapter, the origins, evolution and institutional relations between CONI and Sport e Salute S.p.a. are historically reviewed; this is followed by the diachronic scrutiny of the developments that led to the 2021 sport reform. The second chapter is devoted to an analysis of the protections of sport workers, both professional and amateur: the disciplines of medical checks, accident insurance and pension protection are examined; this is followed by an examination of measures provided in favor of underage sportsmen and the disabled. In the third and final chapter, the main innovations in the field of protection of the health of athletes are discussed. The new sport professions recognized by the reform are examined, and particular attention is paid to the professional figure of kinesiologist, followed by a discussion dedicated to the new “health gyms”, which the new Italian legislation introduced as an important tool for the prevention of chronic non-communicable diseases. The liability profiles that may affect the activity of the operators running this new gym, as well of these new professional figures are also considered.
