Sistem izvora prava, a time i zakona ili pravila koja se mogu primeniti na konkretan slučaj, kako u pogledu odnosa između građanina i države, tako i u pogledu odnosa između privatnih lica, onako kako je utvrđeno u principima koja je razvio Sud u Luksemburgu, nije nimalo jasan i formalizovan. U pitanju je sistem koji ne nudi uvek jasna, precizna i jedno-značna rešenja, već ponekad nastoji da „sakrije prašinu ispod tepiha“ umesto da se otvoreno suoči sa situacijom. Ono što nedostaje evropskom modelu jeste regulatorna odredba koja će utvrditi odnos između komunitarnih i nacionalnih pravila i postaviti čvrst oslonac pravnim aktima Unije, daleko iznad oskudnog sadržaja čl. 288. Ugovora o funkcionisanju Evropske unije. Trenutni model zasniva se gotovo isključivo na sudskoj praksi Suda pravde i na osetljivosti nacionalnih sudova, kao i na evoluciji oba suda. U tom smislu, u izjavi Međuvladine konferencije priloženoj Lisabonskom ugovoru utvrđuje se da komunitarno pravo ima prednost nad nacionalnim pravima ali se i dodaje „pod uslovima koje je utvrdio Sud pravde“. Ovo je, po mišljenju autora, vrlo malo za tako važan poredak kao što je poredak Evropske unije koji je usmeren na više od 500 miliona ljudi. Sve to na teret fizičkih i pravnih lica koja se suočavaju sa teškoćama u identifikaciji propisa koji je potrebno primeniti.

What is lacking in the European model is a regulatory provision that will explain the relationship between Community rules and national rules, that will establish a firm foothold, well above the meagre content of Art 288 of the Treaty on the Functioning of the European Union, for the legal acts of the Union. The present model is almost exclusively based on the case law of the Court of Justice and the sensitivity of the national courts, as well as on the evolution of either courts. In confirmation of this, while it is true that that Declarations annexed to the Final Act of the Intergovernmental Conference which adopted the Treaty of Lisbon state that Community law has priority over national laws, they also add „under the conditions laid down by the case law [of the Court of Justice]“. This is in my opinion very little for an order as important as the European Union order, intended for more than 500 million people. All this at the expense of citizens, companies, businesses, that face the difficulty of identifying the rules to be applied.
