Ovim se radom provodi povijesna analiza razvoja instituta private enforcement u europskom pravu zaštite trţišnog natjecanja. Polazeći od prvih presuda Suda EU, kojima je afirmirana mogućnost naknade štete uslijed povrede antitrust pravila, kasnije se u radu ističu neki vaţni izvori soft law kojima je Europska komisija u proteklom desetljeću nastojala nadomjestiti brojnim nedostatcima uređenja materije u mnogim nacionalnim pravnim poretcima. Nadalje, analiziraju se pravni akti doneseni na razini Europske unije s ciljem da se postigne harmonizacija u tom području. Među raznima ističe se Direktiva 2014/104, a ujedno se i naglašavaju brojne razlike između europskog i američkog sustava. U završnom dijelu rada Autor zaključuje kako proces europeizacije private enforcement je tek na početku te da su postojeće razlike od poretka do poretka velike, budući da se direktivom nije iskazala namjera, a niti sposobnost propisivanja preciznijih pravila, s obzirom da nije se išlo dalje od postavljanja nekih temeljnih načela i regula, dok odgovori na bezbroj otvorenih pitanja koja se odnose na konkretnu primjenu ovog novog instituta i dalje nedostaju.

PRIVATE ANTITRUST ENFORCEMENT - ORIGIN AND DEVELOPMENT IN EU LAW. This paper conducts a historical analysis of the development of the institution of private enforcement in European competition law. Starting from the first judgments of the Court of Justice of the EU, which affirmed the possibility of damages for violating antitrust rules, the paper subsequently highlights some important sources of soft law that the European Commission has tried to compensate for numerous shortcomings in the many national legal systems. Further, there is an analysis of EU secondary legislation enacted in order to achieve harmonization in this area. Among the various instruments, Directive 2014/104/EU stands out and, at the same time, emphasizes the many differences between the European and US systems. In the final part of the paper, the author concludes that the process of Europeanization of private enforcement is only at the beginning and that the existing differences between legal orders are large since the Directive was not intended to or was not able to provide more precise rules. Although there are some basic principles and rules, answers are still lacking to the countless open questions related to the concrete application of this new institution.

Abstract

PRIVATE ANTITRUST ENFORCEMENT - ORIGIN AND DEVELOPMENT IN EU LAW. This paper conducts a historical analysis of the development of the institution of private enforcement in European competition law. Starting from the first judgments of the Court of Justice of the EU, which affirmed the possibility of damages for violating antitrust rules, the paper subsequently highlights some important sources of soft law that the European Commission has tried to compensate for numerous shortcomings in the many national legal systems. Further, there is an analysis of EU secondary legislation enacted in order to achieve harmonization in this area. Among the various instruments, Directive 2014/104/EU stands out and, at the same time, emphasizes the many differences between the European and US systems.
